Medical Assessment 醫學評估

There are two occasions when Medical Assessment is needed.

When a person was injured and involved in legal proceeding on compensation related to a bodily injury during work or in accident arising from negligence, legal team of both sides (the injured person as plaintiff and the insurer as defendant), would assign two specialists (one from each side) to assess the subject jointly and prepare a report on the disability and future loss in earning capacity. This is Joint Medical Examination (JME). The report is Joint Medical Report (JMR).

Another occasion is to assess if a person with disability remains capable in performing certain duties.

The process of Medical Assessment includes review of medical notes, interview of subject, performing physical examination and sometimes arranging updated investigations such as imaging studies. Then the specialist will prepare the report in capacity as expert witness. Unlike usual consultation, there is no doctor-patient relationship established and the arrangement was not intended for treating the suffering.

 

有兩種情況需要進行醫學評估

當某人因工作或他人疏忽而受傷,在涉及法律程序追討賠償時,雙方的法律團隊將指各指派一位骨科專科醫生共同評估傷勢,並共同編寫有關該傷者的殘疾程度和推測未來收入損失的報告。

另一個情況是評估一位之前受傷困擾的康復者是否仍然有能力履行某些職責。

醫學評估的過程包括醫學紀錄的審查,受傷者的訪談,臨床檢查身體,有時還會安排貼近的檢查,例如翻檢核磁共震影像。然後,骨科專科醫生將以專家證人的身份準備報告。 與平常的診病安排不同,過程中雙方並沒有建立醫患關係,而且該整個安排並非旨在治療患者。
